energy services to customers through vigorous competition in the retail energy services
market. It will also assure that public policy objectives, including increased energy

Market Power Issues
The RE3SCO Restructuring Plan will lower prices, and improve
deliver of energy services through vigorous competition in the retail energy services
market. Retail competition is not only compatible with increasing the delivery of
society's public policy objectives, retail access is necessary for the full achievement of
these objectives. The RE3SCO Restructuring Plan empowers the competitive retail
market to help increase achievement of societal objectives and includes mechanisms to
assure that public objectives, including increased levels of energy efficiency, user of
renewable energy, consumer protection, and environmental protection are achieved.

1. Full Customer Choice
- Give all
customers the right to choose their retail energy services providers at the same time.
- Give all customers a direct
voice in pollution reduction by making it possible for them to purchase green power from
competitive providers in a fully competitive market place, so any incremental cost for
customers is as low as possible.
- Use an
independently managed, open competitive process: to select providers of optional bundled
retail energy services packages for customers not interested in choosing energy services
suppliers for themselves; and to select service providers of last resort.
2. Easy-to-understand Pricing
- Provide customers with direct
unbundled price information on energy and reliability services that lets them purchase and
pay for only the specific services what they want to buy.
3. Open access to all electric transmission and distribution services
- Provide common
carrier transmission, distribution, system coordination, and reliability services -- with
an independent provider, regional transmission and distribution tariffs, and regional
planning.
- Provide common
carrier services for customer billing, customer metering and customer energy use
information using independent providers and also allow others to provide these
services.
4. Sustained Attainment of Societal Objectives
- Collect
transmission and distribution system connection fees (a non-bypassable systems benefits
charge) from all users to fund acquisition of increased energy efficiency, renewable
energy and environmental improvement, as well as to fund consumer protection programs and
other public policy objectives.
- Use these fees
to operate an independently managed open competitive process for any acquisition of
increased energy efficiency, renewable energy or environmental improvement. For
efficiency, renewables, and environmental improvements acquired with these fees make
payments only for measured and verified performance.
5. Vigorous Retail Competition Created and Maintained by Addressing Market Power
Issues
- Allow
bilateral electricity purchases and sales. Require reporting of only the physical
transactions (not the prices) to the system operator.
- Effectively
address market power, self-dealing, cost shifting and other potential market chilling
activities by implementing in restructuring a game proof system that prevents potential
abuses so that all generation companies and all retail services companies have the
opportunity to compete on a truly level playing field in retail markets without being
encumbered by unnecessary regulation.
